Right of withdrawal

These instructions apply to consumers (§ 13 BGB, German Civil Code) who book a paid Studim.ai plan. The free plan involves no payment; you end it at any time by deleting your account in Settings.

[LAWYER: Paid plans are sold through Lemon Squeezy (Sold through Link, LLC) as merchant of record, which makes it the contracting party of the purchase. Clarify whether the withdrawal instructions must be given in Lemon Squeezy's name, in our name or in both, and who is the addressee of a withdrawal. Until then these instructions name us as the addressee; withdrawals that reach us are forwarded to Lemon Squeezy without delay.]

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us ([FULL NAME], [COMPANY LEGAL FORM], [STREET AND NUMBER], [POSTCODE CITY], Germany, phone: [PHONE, OPTIONAL], email: hello@studim.ai) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

[LAWYER: The paragraph on delivery costs is taken unchanged from the statutory model. For a pure service contract it can be dropped; we kept it so as not to lose the protection of the model text. Please decide.]

Expiry of the right of withdrawal on early start

Studim.ai is a continuing service (transcription, translation, Library) that we usually provide immediately after the purchase. That is why we ask for your express consent during checkout that we start the service before the withdrawal period ends. The legal consequences are:

• Service (§ 356 (4) BGB): if you agreed to the early start and confirmed that you know you lose your right of withdrawal once the contract is fully performed, the right of withdrawal expires as soon as we have fully performed the service. If you withdraw before that, you pay the proportion for the service already provided (see above).
• Digital content (§ 356 (5) BGB): as far as the contract concerns the supply of digital content not on a tangible medium, the right of withdrawal already expires when performance begins, provided you expressly agreed, confirmed that you know you lose the right of withdrawal, and we confirmed that consent to you (§ 312f BGB).
• [LAWYER: Decide whether Studim.ai counts as a service, digital content or a digital service; this decides which of the two consent statements the checkout shows and whether a proportionate amount is owed on withdrawal. Our suggestion: service, because performance runs over the term.]

Consent statements in the checkout

Before payment, the checkout shows you one of the following statements with a checkbox. Without your consent we start the service only after the withdrawal period has ended. We store which statement you confirmed, with its wording, language, date and time, together with your purchase.

Service variant

"I expressly request that you begin performing the service before the withdrawal period expires. I am aware that I lose my right of withdrawal once the contract has been fully performed."

German original: "Ich verlange ausdrücklich, dass Sie mit der Ausführung der Dienstleistung vor Ablauf der Widerrufsfrist beginnen. Mir ist bekannt, dass ich bei vollständiger Vertragserfüllung mein Widerrufsrecht verliere."

Digital content variant

"I expressly agree that you begin performing the contract before the withdrawal period expires, and I acknowledge that I lose my right of withdrawal once performance has begun."

German original: "Ich stimme ausdrücklich zu, dass Sie vor Ablauf der Widerrufsfrist mit der Ausführung des Vertrags beginnen, und ich habe zur Kenntnis genommen, dass ich mit Beginn der Ausführung mein Widerrufsrecht verliere."

Voluntary refund within 14 days

Independently of the statutory right of withdrawal, we refund the full purchase price as a goodwill gesture if you are not satisfied with the service within 14 days of your first purchase of a paid plan. Write to support@studim.ai. The refund is made through Lemon Squeezy to the payment method you used for the purchase, and your account switches to the Free plan immediately. This goodwill rule applies once per person and not to renewals. It does not restrict your statutory right of withdrawal. Details are in § 7 of the terms. [CONFIRM WHEN G3 PAYMENTS GO LIVE]
